§ 1. Definitions

The following terms used in these Terms and Conditions shall have the meanings set forth below:

1. Program - the Lavelmo membership program enabling the use of services under a recurring membership.
2. Organizer - Kuisim sp. z o.o. with its registered office in Kraków, ul. Kazimierza Wielkiego 4/4.
3. User - a natural person who has entered into a membership agreement under the Program.
4. Membership - a subscription-based form of using barbershop services under the Program.
5. Billing period - a period of 30 days counted from the day the membership is activated or last renewed.
6. Salon - a service salon using Lavelmo.
7. System - the IT system operating the Program, including the visit booking system and the payment system.

§ 2. General provisions

1. The administrator and organizer of the program is Kuisim sp. z o.o., ul. Kazimierza Wielkiego 4/4, 30-074 Kraków.
2. The Lavelmo Program is a membership program enabling the use of services in the form of a recurring membership.
3. Membership in the Program is subscription-based and consists of access to specified services in exchange for a periodic membership fee.
4. The membership agreement may be concluded via:
   - the mobile application,
   - the website,
   - in the salon or by phone.
5. Acceptance of these Terms and Conditions is a condition of concluding the agreement.
6. The Program operates within the VIPS system handling payments and membership management.

§ 3. Scope of membership

1. The membership includes 3 visits within a 30-day period, which constitutes the billing period.
2. Visits unused within a billing period do not carry over to the next billing period.
3. The membership is assigned to one selected Salon and cannot be changed.
4. The User may use the services of any barber in the selected Salon.
5. The membership renews automatically every 30 days (auto-renew), unless terminated in accordance with these Terms and Conditions.

§ 4. Bookings and visits

1. A visit requires a prior booking.
2. Cancelling a visit later than 18 hours before the scheduled time results in the visit being deemed used.
3. Being more than 15 minutes late may result in refusal to perform the service and the visit being deemed used.
4. The Salon may refuse to perform the service in the event of:
   - the client being under the influence of alcohol or intoxicants,
   - aggressive behaviour,
   - a health condition preventing the safe performance of the service.

§ 5. Payments

1. The membership fee is charged on a recurring monthly basis.
2. Payments are processed via the payment operator Stripe.
3. By accepting these Terms and Conditions, the User consents to the recurring charging of the indicated payment method with the fee for subsequent billing periods until the membership is cancelled.
4. The first membership fee is charged immediately upon activation of the membership.
5. Subsequent fees are charged automatically on the membership renewal date, with the card being charged one month later at the same time of day as the first transaction.
6. In the event of the first failed payment attempt, the membership is suspended. During the suspension period, access to the services is withheld until the outstanding payment is settled.
7. The System makes a maximum of 3 attempts to charge the indicated payment method.
8. In the event of no successful payment after 3 card charge attempts, the Organizer may permanently deactivate the User's membership, resulting in loss of access to the services under the Program.
9. The Organizer stipulates that, for technical reasons related to the operation of the payment operator, the actual moment of charging the card may occur at a time slightly different from the indicated time frame, which does not affect the validity and effectiveness of the charge.

§ 6. Membership cancellation

1. The User may cancel the membership at any time, with no notice period, by e-mail to kontakt@lavelmo.com
2. Submitting a cancellation disables the automatic renewal of the membership.
3. The membership remains active until the end of the paid billing period and expires upon its lapse.
4. The fee for a billing period already started is non-refundable, subject to § 7 (right of withdrawal).
5. Until the membership expires, the User retains the right to use the services covered by the membership in accordance with the rules set out in these Terms and Conditions.

§ 7. Right of withdrawal

1. A User who is a Consumer has the right to withdraw from the agreement within 14 days of its conclusion.
2. If services were used before the withdrawal, the visits used are settled according to the salon's standard price list.
3. The refund is made after deducting the value of the services used, within 14 days of the effective withdrawal.

§ 8. Liability

1. The Salon is responsible for the quality of the service performed.
2. The Organizer's liability is limited to the amount of the monthly membership fee.
3. The Organizer is not liable for interruptions in the operation of the System resulting from causes beyond its control.

§ 9. Personal data

1. Personal data is processed in accordance with the Privacy Policy.
2. The payment operator is Stripe.

§ 10. Complaints

1. The User has the right to file a complaint regarding the non-performance or improper performance of the services covered by the membership program or the incorrect operation of the Lavelmo system.
2. The complaint should be submitted in writing (including electronically) to the e-mail address: kontakt@lavelmo.com or to the address of the Company's registered office.
3. The complaint should include at least: the User's first and last name, correspondence address, a description and date of the event constituting the basis of the complaint, and the User's request.
4. The Organizer will consider the complaint within 14 days of its receipt. The response to the complaint will be sent to the User's e-mail address.
5. In disputed matters, the User may use out-of-court methods of handling complaints and pursuing claims, in accordance with applicable law.

§ 11. Force Majeure

1. The Organizer is not liable for the non-performance or improper performance of obligations under these Terms and Conditions if it is caused by circumstances of Force Majeure.
2. Force Majeure means an external event that is impossible to foresee and impossible to prevent, in particular: fire, flood, epidemics, orders of state authorities, strikes, natural disasters.
3. In the event of Force Majeure, the performance of the membership may be suspended for its duration. The Organizer will inform Users about the suspension of services immediately after the obstacle ceases.

§ 12. Final provisions

1. The Organizer reserves the right to amend these Terms and Conditions.
2. Users will be informed of any amendment at least 30 days in advance.
3. If any provision of these Terms and Conditions proves invalid, this does not affect the validity of the remaining provisions.
4. In matters not regulated herein, the provisions of Polish law apply.
5. Disputes will be resolved by the court having jurisdiction over the company's registered office.
6. The current program price list constitutes Appendix No. 1 to these Terms and Conditions.

Appendix No. 1 - Lavelmo Membership Program

Effective from: September 1, 2026

This appendix constitutes an integral part of the Terms and Conditions of the Lavelmo program operated by Kuisim sp. z o.o.

Lavelmo is a closed membership program addressed to clients of contracted service salons, enabling regular use of barbershop services under a recurring membership.

The program was created for clients who want to maintain a consistent standard of appearance and use salon services in a regular and convenient way.

The first edition of the program covers the Gentlemen Barber Shop barbershops.

Memberships are sold in several pricing pools, and the membership price may increase with subsequent sales stages.

Scope of membership

Each membership plan includes:

• 3 visits within a 30-day period
• the option to use the services of any barber
• performance of services in accordance with the rules set out in the terms and conditions

Unused visits do not carry over to the next billing period.

Final provisions

The price list set out in this appendix applies until the places in the first sales pool of the program are exhausted.

The Organizer reserves the right to introduce subsequent sales pools and subsequent editions of the membership program.
